David A. Marshall, Jr. is an Alexandria, Virginia man who was 57 years old when federal agents arrested him in the spring of 2024 - three years and four months after January 6, 2021 - and who, so far as the public record shows, was never convicted of anything. Charged. Never convicted. That distinction is the entire point of this page. WHO HE IS FACT - Marshall is a resident of Alexandria, Virginia, in the Washington, D.C. metropolitan area, and was 57 at the time of his arrest (DOJ; Alexandria Daily Voice). FACT - He was arrested May 1, 2024 in Virginia, one of the last January 6 arrests the Justice Department made before the 2024 election. FACT - Reporting states investigators identified him after a former coworker recognized him - meaning David A. Marshall, Jr. had gone about his ordinary working life in northern Virginia for more than three years, in plain sight, in the same region as the Capitol itself. NEEDS AUTHENTICATION - His trade, employer, family, and military service if any have not been reported publicly. This archive has no account of his life beyond the charging documents. If a family member or friend wants that corrected, we will publish it. THE LEGAL FIGHT FACT - Marshall was charged by criminal complaint in the U.S. District Court for the District of Columbia with two felony counts - civil disorder, and assaulting, resisting or impeding certain officers - plus seven misdemeanor counts including assault by striking, entering and remaining in a restricted building or grounds, disorderly and disruptive conduct, engaging in physical violence in a restricted building or grounds, and parading or demonstrating in a Capitol building. FACT - Those are allegations. This archive has located NO guilty plea, NO trial verdict, and NO sentence for David A. Marshall, Jr. Under American law he is presumed innocent of every one of them. FACT - On January 20, 2025, the presidential January 6 clemency proclamation directed the dismissal of all pending January 6 indictments and informations. His case was pending when that proclamation issued. NEEDS AUTHENTICATION - The specific docket entry dismissing his case has not yet been captured in this archive. Nine counts on paper. Zero convictions in the record. That is what this profile says, because that is what the record says. CASE RECORD Name: David A.
